Restoring Sovereignty in Judea and Samaria

While the world’s attention remains divided, with eyes on Iran and Gaza, the Israeli Security Cabinet recently passed a series of decisions that may be the most consequential changes to the legal status of Judea and Samaria (the West Bank) in decades. Under the leadership of Finance Minister Bezalel Smotrich and Defense Minister Israel Katz, the government approved measures that effectively begin to erase the "Green Line" from a legal and administrative perspective.

These moves by the Israeli government represent a long-overdue application of sovereignty and an attempt to correct historical injustices, introduce transparency, and counter rampant violations of the Oslo Accords by the Palestinian Authority (PA).

A Little Bit of Background:

The 1949 armistice line, also known as the “Green Line”, is the border Israel and Jordan agreed to following Israel’s War of Independence. Following its liberation of Judea and Samaria in 1967, Israel left in place many of the land deeds and laws that date back to the Ottoman empire.

Major changes came with the Oslo Accords of the 1990s when Israel agreed to give the Palestinians a huge amount of autonomy with the creation of the Palestinian Authority and the ceding of control of certain areas of Judea and Samaria. The land was divided into three areas. Area A is almost exclusively under PA control, except when Israel needs to enforce security. You may be familiar with the big red signs that stand at the entrances to Area A, warning Israelis not to enter because of danger to their lives.

Area B is under joint-Israeli and PA administration. Area C is under Israeli control and is where the Jewish communities of Judea and Samaria are located. Since 1967, Judea and Samaria has been largely under military control, with distinct laws and governance compared to the rest of Israel. The latest decisions aim to treat more of the administration of Judea and Samaria the same as any other region of Israel.

The Decisions: A shift from Military Rule to Civil Law

  1. Repeal of discriminatory Jordanian laws: One of the most significant shifts is the repeal of Jordanian-era laws that prohibited non-Arabs from purchasing land in Judea and Samaria.
  2. Publication of Land Registries: For the first time, land ownership records in Judea and Samaria will be made public. Lifting this secrecy allows for a transparent, open market where buyers can identify landowners and purchase property more easily.
  3. Revival of State Land Purchases: The government revived a "land purchase committee" that has been dormant for 22 years. This mechanism allows the State of Israel to directly acquire land in Judea and Samaria for settlement expansion and strategic planning.
  4. Expanded Enforcement in Areas A and B: The Cabinet authorized increased Israeli oversight and enforcement activities in Areas A and B of Judea and Samaria. This allows Israel to step in where the PA has failed, specifically regarding water theft, damage to archaeological heritage sites, and environmental hazards. We’ve written before about PA sanctioned destruction to Joshua’s Altar. The decision aims to bring an end to incidents like this.
  5. Hebron Building Authority: Control over building permits for the Jewish community of Hebron, including the area around the Tomb of the Patriarchs, was transferred from the Palestinian-controlled Hebron municipality to Israel. This ends the absurdity of Jewish residents needing approval from a hostile municipal body to build their homes.
  6. Municipal Authority for Rachel’s Tomb: A new municipal body was established to handle the cleaning and routine maintenance of the holy site in Bethlehem, ensuring it is treated with the dignity it deserves.

The Yesha Council, an umbrella organization representing settlement municipal authorities in the West Bank, called the decisions on Sunday among “the most significant decisions made by the State of Israel since its return to Judea and Samaria 58 years ago.”
“The government of Israel announced today, in practice, that the Land of Israel belongs to the Nation of Israel,” the council said, adding that the decisions “rectified an injustice of many years and are entrenching Israeli sovereignty on the ground, de facto.”

“Removing barriers, repealing discriminatory Jordanian legislation and restoring civil equality are a Zionist, moral and security step of the highest order,” said Yossi Dagan, head of the Samaria Regional Council. “This is a tremendous boost to settlement, to holding the land and to the future of the State of Israel. I thank Finance Minister Bezalel Smotrich and call for continuing until full sovereignty is applied in Judea and Samaria.”

The Predictable Global Chorus

As Israel moves to correct these wrongs and assert its rights, the international reaction has followed a familiar script. The UK Foreign Office issued a warning that these changes "harm prospects for peace”. The response from the Trump White House has been measured. The administration did not strongly oppose the decisions, but clarified that President Trump "does not support Israel annexing the West Bank".

Soon after the decisions  were announced, Hamas called for an escalation of violence against Israel from the Palestinians and Arab countries surrounding Israel. Security leaders in Israel have said that the implementation of some of the decisions will not take place until after the Muslim month of Ramadan, when tensions are heightened.

What It Means: Sovereignty in Practice

This is a normalization of Jewish life in the region. It signals that the era of treating Judea and Samaria as a temporary bargaining chip is over. Instead, the government is ensuring that the region is governed by the rule of law, fairness, and the protection of Jewish heritage, regardless of what critics in the UN might say.

From Japan in the Far East, I praise the Israeli government for its wonderful decision.
The Land of Israel belongs to the Jewish people, and G-d’s decisions transcend international law.

At long last and not before time! Trump has NO right nor does anybody else throughout the world to criticise Israelis for living in their own land!! THEY CAN MIND THEIR OWN BUSINESS! Why should Israel have to submit to world opinion? She doesn’t intrude into the affairs of other countries! The ‘palestinans’ must be fully removed from Judea and Samaria so that Israelis can have their own land back to build their homes! No ‘Area A or Area B’ and Israel must stop forwarding funds to the PA so they can pay-for-slay! And it must stop now. ‘Judenrein’ in Israel? Are you kidding? It’s insanity! This is a great plan and well overdue!!

These areas were Israel’s RIGHTFULLY since the ‘67 war. You should have been occupying and governing them ever since. Shame on all of those who interfered and counselled you otherwise. However, Israel needs to trust God who gave you the land thousands of years ago and STOP listening to others, even though they may seem well-meaning, who advise you otherwise, including our own President Trump. It is your country, your land, your gift from God. You do not need our permission to occupy and rule it, only God’s Blessing.
